Experience

Andy is a partner at Butler Rubin Saltarelli & Boyd and a member of the firm’s Management Committee.

Andy has extensive experience representing corporations, partnerships, and individuals in a wide range of commercial disputes before trial and appellate courts, administrative agencies, and arbitration panels throughout the country. He has litigated multi-million dollar reinsurance disputes on behalf of cedents and reinsurers and represented plaintiffs and defendants in cases involving claims of employment discrimination, antitrust price fixing and monopolization, breach of contract, breach of non-compete agreements, statutory, common law, and consumer fraud, copyright infringement, and breach of fiduciary duty.

Andy is an adjunct professor at Northwestern University School of Law where he teaches Pretrial Advocacy.

Representative Matters

Complex Commercial Litigation

  • Represents insurer in billion-dollar lawsuit alleging fraud and breach of contract against lenders, which were issued credit insurance policies for hundreds of thousands of home equity loans and lines of credit. Old Republic Insurance Company v. The Bank of New York Mellon, Case No. 08 CH 47501 (Cook County Circuit Court).
  • Represents insurance company in dispute with its insurer concerning coverage for multi-million dollar claim under professional liability policy. Lexington Ins. Co. v. Horace Mann Ins. Co., Case No. 11 CV 2352 (N.D. Ill.).
  • Represents client in action brought by a litigation trust for the benefit of creditors of Extended Stay Hotels seeking recovery for allegedly illegal dividend distributions.  In re Extended Stay, Inc.et al., Case No. 09-13764 (Bankr. S.D.N.Y.).
  • Represented title insurers in MDL proceeding in which insured alleges breach of closing protection letters and seeks indemnification in connection with approximately 205 opt-out cases.  In re Ameriquest Mortgage Co. Mortgage Lending Practices Litigation, Case No. 05 CV 7097 (N.D. Ill.).
  • Represented real estate investment trust in breach of contract action brought by former executive. Fendley v. Prime Group Realty Trust, et al., Case No. 2007 L 5519 (Cook County Circuit Court).
  • Represented former parent facilitator in employment discrimination suit against the Waukegan Board of Education. Hernandez v. Board of Education of the Waukegan Community Unit School District No. 60, et al., Case No. 2008 CV 3290 (N.D. Ill.).
  • Represented owner of 38-story office building and obtained dismissal of complaint seeking rescission of agreement to sell property and building. YPI 180 N. LaSalle Owner, LLC v. 180 N. LaSalle II, LLC, Case No. 2009 CH 6451 (Cook County Circuit Court). Successfully defended dismissal on appeal. YPI 180 N. LaSalle Owner, LLC v. 180 N.   • Represented insurance company in dispute with Lloyd’s of London syndicates and other insurers concerning coverage for multi-million dollar claim under professional indemnity policy. Safeco Ins. Co. of Ill. V. Certain Underwriters of Lloyd’s, London, et. al., Case No. 14-2-00573-3 (Washington State Court).
  • Represented former manager of a 39-story office building in breach of contract suit against building’s owner. Prime Group Realty L.P. v. 131 S. Dearborn LLC, Case No. 2009 L 12145 (Cook County Circuit Court).
  • Represented large direct merchant of traditionally styled clothing in action alleging, inter alia, breach of contract, fraud, and copyright infringement against a software provider. Lands’ End, Inc. v. Versata Software, Inc., Case No. 06 CV 132 (W.D. Wis.).
  • Represented a Chicago developer in construction defect cases and related disputes with client’s insurance carriers. Board of Directors of East Side Lofts Condominium Association v. East Side Lofts, LLC, et al., Case No. 2001 CH 3459 (Circuit Court of Cook County); Empire Indemnity Insurance Company v. MCZ Development Corp., Case No. 2001 CH 9502 (Circuit Court of Cook County); Randolph Place Residences Condominium Association v. Canal Street Lofts, LLC, et al., Case No. 2001 L 14919 (Cook County Circuit Court).

Reinsurance Arbitration

  • Represented cedent at hearing and obtained award for loss arising out of policy’s supplementary payments provision.
  • Represented cedent in dispute with reinsurer concerning the number of occurrences in underlying asbestos, silica, and priest-abuse claims.
  • Represented cedent in dispute with reinsurer regarding whether third-party administrator expenses were properly ceded as allocated loss adjustment expense.
  • Represented cedent in matter involving reinsurer’s claim that finite reinsurance policy should be reformed based on mutual mistake.
  • Represented reinsurer in matter involving the consolidation of arbitrations arising out of multiple treaties.

Antitrust Litigation

  • Represented global engineering and construction company in the first consummated merger case tried in an administrative hearing before the Federal Trade Commission in more than two decades. In the Matter of Chicago Bridge & Iron Company et al., Docket No. 9300 (F.T.C.).
  • Represented marketers of sulfur-based products in action alleging a conspiracy in the sulfuric acid industry in violation of Section 1 of the Sherman Act. In re Sulfuric Acid Antitrust Litigation, MDL No. 1536 (N.D. Ill.).
  • Represented corrugated container manufacturers in class action, and subsequent opt-out litigation, alleging coordinated restrictions on linerboard supply. In re Linerboard Antitrust Litigation, MDL No. 1261 (E.D. Pa.).
  • Represented world-leading producer of decorative surfacing products in class action alleging price-fixing conspiracy. In re High Pressure Laminates Antitrust Litigation, MDL No. 1368 (S.D.N.Y.).

Clerkship

During law school, Andy served as a clerk for the Criminal Justice Counsel in the Office of the Public Defender in Cook County, Illinois, where he assisted in the exoneration of a man who had been wrongfully convicted and subsequently imprisoned for almost a decade.

Community Involvement

Andy currently serves on the Board of Directors for the Chicago Coalition for the Homeless (2009 – present). He previously served on the Board of Directors for the Insurance Industry Charitable Foundation (2013 – 2015) and was selected and served on the Superintendent’s Citizen Finance and Facilities Committee for North Shore School District 112 (2012 – 2014).
