Health Care Cases To Watch In 2018


At the beginning of a new year, legal professionals often take assessment of anticipated issues and cases to watch that could shape various industries. One key area in which lawyers are particularly focusing on is the health care sector. 2018 brings with it a sprawling assortment of crucial cases to monitor, including multibillion-dollar battles over Medicare reimbursement, Affordable Care Act spending and False Claims Act (FCA) liability.

In an article published in Law360 on Jan. 1 titled “Health Care Cases to Watch in 2018,” reporter Jeff Overly talks to a number of health care lawyers to get their input on a number of big-name cases, including matters that could lead to major developments in the 340B program, the FCA’s medical necessity theory and the Escobar decision, among other issues. Butler Rubin partner Ursula Taylor was one of the attorneys who provided commentary for the story. She spoke on key elements of ACA payments, the federal government’s policies on Medicare Advantage overpayments and an opioid-related multidistrict litigation.

For instance, regarding ACA payment, Taylor told Law360, “A result favorable to health plans would showcase the potential for the judiciary to act as a powerful stopgap where there is a failure in appropriations for promised ACA payments.”
