| | Experience: | David has successfully represented clients in a variety of different litigation contexts. He concentrates his practice on general commercial and reinsurance litigation.
He began his legal career as a Public Interest Law Initiative Fellow at the Northwestern University Legal Clinic working on domestic abuse cases. He then moved on to Mayer, Brown, Rowe and Maw LLP where he joined the tax controversy department, representing clients in multiple stages of tax representation, from audit to preparation for litigation. He has also worked as a criminal defense attorney, assisting clients both at trial and in resolving problems that arise in the context of criminal prosecutions. David joined Butler Rubin in January 2005. |
| | Representative Cases: | AIG et al. v. ACE et al. (N.D. Ill. Case No. 07 CV 2898): Represent one of the largest writers of workers compensation insurance in $1 billion dispute with AIG regarding AIG’s reporting of workers compensation premiums.
Reinsurance Arbitration: Represented a retrocedent in a dispute over alleged non-disclosures in placing a retrocessional property catastrophe program.
Reinsurance Arbitration: Represented reinsurer in a dispute over the aggregation of asbestos claims.
Commercial Arbitration: Represented executive seeking severance benefits denied by former employer under a change-in-control severance policy.
Reinsurance Arbitration: Represented cedent in dispute arising out of surety business produced by a general agent.
People v. Orik (Lake Cty. Ct. 2004). Represented client in criminal case involving allegations of possessing stolen motor vehicles.
I Imagine Studio, Inc. v. Tsipis, et al. (Cook Cty. Ct. 2004). Lead counsel representing business in civil suit against debtor corporation seeking to pierce corporate veil and attach liability to sole shareholder.
People v. DeFrancisco (Cook Cty. Crim. Ct. 2004). Second chair in first-degree murder trial. Represented client through two criminal trials (first trial resulted in mistrial), post-trial motions and through sentencing.

Fernandez v. Mukasey, 544 F.3d 862 (7th Circuit): Lead counsel. Represented immigrants contesting deportation on the grounds of simple drug possession offenses. Although the Seventh Circuit initially ruled against Butler Rubin's clients, this decision was later overruled by the United States Supreme Court in Fernadez v. Holder, 2010 WL 2471068 (June 21, 2010), based on the Court's holding in Carachuri-Rosendo v. Holder, 130 S.Ct. 2577 (June 14, 2010).
In the Matter of L-K- (U.S. Immigration Ct. 2005). Lead counsel. Defended Iraqi pro bono client in Deportation proceedings before United States Executive Office for Immigration Review.
People v. Gonzalez (Cook Cy. Ct. 2004). Pro Bono case, working in conjunction with the Northwestern University Legal Clinic. Represented client before the trial court in post-trial motion requesting DNA testing. |
